Landmark Judgments Under Section 9 of the Insolvency and Bankruptcy Code (IBC)

Introduction

The Insolvency and Bankruptcy Code (IBC) has revolutionized India's insolvency landscape by providing an efficient and time-bound framework for the resolution of distressed assets. Section 9 of the IBC empowers operational creditors to initiate the insolvency process against defaulting corporate debtors. In this case, the Supreme Court of India addressed the issue of whether an operational creditor's application under Section 9 could be rejected due to an unpaid operational debt. The court held that the existence of a dispute between the parties regarding the unpaid debt was a valid ground for rejecting the application. This judgment established that a mere unpaid operational debt, without any bona fide dispute, is sufficient to trigger the insolvency process.

Innoventive Industries Ltd. v. ICICI Bank Ltd.

The Innoventive case is widely regarded as a landmark judgment that provided important clarifications on the role and powers of the National Company Law Tribunal (NCLT) in insolvency proceedings. The Supreme Court held that the NCLT had the authority to review and decide on the merits of an insolvency application. K. Kishan v. Vijay Nirman Company Pvt. Ltd.

In this case, the Supreme Court ruled that the limitation period for initiating insolvency proceedings under Section 9 of the IBC is three years from the date of default. Innoventive Industries Ltd. v. Maharashtra Seamless Ltd.

The Supreme Court, in this case, held that the initiation of the insolvency process suspends all pending litigation against the corporate debtor. Swiss Ribbons Pvt. Ltd. v. Union of India
